These Terms of Service (“Terms”) govern access to and use of DashCare Patient Assist, including its Chrome extension and supporting services (collectively, the “Service”), made available by Visio Dental Management, LLC (“we,” “us,” or “our”).
Acceptance and authorized use
By accessing or using the Service, you agree to these Terms. The Service is intended only for personnel authorized by a participating dental practice or organization. You may use it solely for legitimate business purposes within the permissions granted by your organization.
Accounts and access
You must use your own approved account, keep access credentials secure, and promptly report suspected unauthorized access. You are responsible for activity performed through your account. We or your organization may suspend or revoke access when authorization ends or when needed to protect patients, users, systems, or data.
The Service
Patient Assist helps authorized operators identify caller context, retrieve permitted patient and appointment information from tab32, and submit operator-requested workflow actions. The Service is an intermediary interface; tab32 and the applicable dental practice remain responsible for their source records and operational decisions.
Patient information and professional responsibility
You may access patient or practice information only when permitted by your organization and applicable law. You must verify information before relying on it, follow your organization’s privacy and security policies, and use appropriate professional judgment. The Service does not provide medical, dental, legal, or compliance advice and must not be used for emergencies.
Acceptable use
You must not:
- access records or organizations you are not authorized to access;
- share accounts, tokens, credentials, or patient information improperly;
- interfere with, probe, reverse engineer, or bypass Service security;
- introduce malicious code or use the Service for unlawful activity; or
- copy, resell, or commercially exploit the Service without permission.
Third-party services
The Service works with third-party systems, including Google, Nextiva, tab32, cloud infrastructure, and diagnostics providers. Their services may be governed by separate terms and policies. We are not responsible for third-party systems outside our control, including their availability or source data.
Privacy
Our Privacy Policy explains how the Service handles information. Your organization may impose additional privacy, security, and record-retention requirements.
Availability and changes
We may maintain, update, restrict, suspend, or discontinue all or part of the Service. We do not guarantee uninterrupted or error-free operation. You remain responsible for following your organization’s fallback procedures when the Service or an integrated system is unavailable.
Intellectual property
The Service and its software, design, and content are owned by us or our licensors and are protected by applicable intellectual-property laws. These Terms grant only a limited, revocable, non-transferable right to use the Service as authorized; no ownership rights are transferred.
Disclaimers
To the fullest extent permitted by applicable law, the Service is provided “as is” and “as available,” without warranties of any kind, whether express, implied, or statutory. We disclaim implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. Some jurisdictions do not allow certain disclaimers, so these exclusions may not apply to you.
Limitation of liability
To the fullest extent permitted by applicable law, we and our affiliates, officers, employees, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of data, revenue, profits, or business opportunity, arising from or related to the Service. Liability that cannot lawfully be excluded or limited remains unaffected.
Changes to these Terms
We may update these Terms to reflect changes to the Service or applicable requirements. Updated Terms will be posted with a revised effective date. For material changes, we will provide advance notice through the Service or the operator’s organization and request affirmative acceptance where required by applicable law. Continued use after an update constitutes acceptance to the extent permitted by applicable law.
